Terms of Service

These Terms of Service (“Terms”) govern your use of SimplyStudy at simplystudy.net and related applications (the “Service”), operated by SimplyStudy (“we”, “us”, “our”). By creating an account, using guest mode, subscribing to Premium, or otherwise using the Service, you agree to these Terms and our Privacy Policy.

If you purchase Premium, payment is processed by our payment partner Stripe, and Stripe’s terms for checkout and payment processing may also apply to that purchase. See section 6 and our Refund & Cancellation Policy.

1. Eligibility

You must be at least 13 years old to use SimplyStudy. If you are under 18, you should use the Service with permission from a parent or guardian. You are responsible for ensuring your use complies with applicable laws in your country.

2. Your account

• You must provide accurate registration information and keep your credentials secure.
• You are responsible for activity under your account.
• Notify us promptly if you suspect unauthorized access.
• We may suspend or terminate accounts that violate these Terms or pose a security or abuse risk.
• One person should not create multiple accounts to bypass usage limits or Premium restrictions.

3. Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, harassing, or fraudulent purposes
• Attempt to bypass usage limits, authentication, quotas, or Premium restrictions
• Scrape, reverse-engineer, or overload our systems, or interfere with other users
• Upload malware or content that infringes others’ intellectual property or privacy
• Share account access commercially or resell the Service without our permission
• Use the Service to generate spam, malware, or content intended to cheat in ways that violate your school’s academic integrity rules (you are solely responsible for how you use study materials)

We enforce daily AI quotas and rate limits to keep the Service fair for all users. Limits may differ for guest, free, and Premium accounts and may change over time.

4. AI-generated content disclaimer

SimplyStudy uses artificial intelligence to generate lessons, quizzes, flashcards, explanations, exam drafts, audio, coaching, and other study content. AI output may be inaccurate, incomplete, biased, or outdated.

It is provided for educational support only and is not a substitute for teachers, textbooks, official curricula, accredited institutions, or professional advice (medical, legal, financial, or otherwise). Always verify important information with authoritative sources before relying on it for exams, coursework, grades, or decisions.

We do not guarantee the accuracy, completeness, originality, or suitability of AI-generated content. You use AI features at your own risk.

5. Intellectual property and your content

The Service, including its design, branding, software, and original materials we create, is owned by SimplyStudy or its licensors. You receive a limited, personal, non-exclusive, non-transferable license to use the Service for your own learning.

You retain ownership of study notes and content you upload. By submitting content to generate study kits or other features, you grant us a worldwide, royalty-free license to process, store, and transmit that content solely as needed to provide the Service to you.

You represent that you have the right to upload content you submit and that doing so does not violate others’ rights or applicable law.

6. Premium subscriptions and billing (Stripe)

Some features require a paid Premium subscription. Prices and included features are shown in the app and at checkout.

Payment processing. Premium is sold by SimplyStudy. Payments are processed by Stripe (Stripe Checkout and related billing tools) as our payment processor. Stripe handles card/wallet processing, receipts, and tax-related checkout details where configured, and may present its own checkout terms. Your Premium access in SimplyStudy is fulfilled by us after Stripe confirms a successful purchase or active subscription.

• Subscriptions renew automatically unless cancelled before the renewal date through the billing / customer portal provided for your purchase.
• Once payments are live, you can manage or cancel Premium inside SimplyStudy (Premium → Manage subscription / Cancel). That uses Stripe’s billing tools (such as the Stripe Customer Portal) behind the scenes. You can also use the link in your receipt email as a backup.
• Refunds and cancellations are described in our Refund & Cancellation Policy, subject to applicable law and Stripe’s payment processes.
• We may change Premium pricing or features with reasonable notice; changes typically apply to future billing periods.
• If a payment fails or a subscription ends, Premium features may be revoked until payment is restored.

7. Guest mode and free tier

Guest and free accounts have limited daily access to AI features. When you are signed in, XP, streak, and library items sync to your account. Guest-saved library items stay on that device and can be lost if you clear browser data or switch devices.

8. Availability and changes to the Service

We aim to keep SimplyStudy available, but we do not guarantee uninterrupted access. Features, quotas, models, and Premium entitlements may change as we improve the product. We may temporarily suspend access for maintenance, security, or abuse prevention.

9. Termination

You may stop using the Service at any time. You may delete your account from Profile where available, or contact us at info@simplystudy.net. Cancelling Premium does not automatically delete your account.

We may suspend or terminate access if you breach these Terms, abuse the Service, fail to pay for Premium, or if required by law. Sections that by nature should survive (disclaimers, liability limits, IP, governing law) will survive termination.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT AI OUTPUT WILL MEET YOUR ACADEMIC OR PROFESSIONAL REQUIREMENTS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIMPLYSTUDY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, GRADES, EXAM OUTCOMES, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID FOR SIMPLYSTUDY PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 50.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded under applicable law (including certain consumer rights).

12. Changes to these Terms

We may modify these Terms from time to time. Material changes will be reflected by updating the effective date. Continued use after changes constitutes acceptance, except where mandatory law requires a different process.

13. Governing law

These Terms are governed by the laws of Slovenia and applicable European Union regulations, without regard to conflict-of-law principles. Where mandatory consumer protection laws in your country provide you additional rights, those rights remain unaffected.

Disputes should first be raised through our in-app Feedback channel or email. If unresolved, competent courts in Slovenia may have jurisdiction, subject to mandatory consumer rules in your place of residence.

Purchases processed by Stripe may also be subject to Stripe’s terms and dispute processes for payment-related matters.
